Minnesota accepts J-1 visa waiver applications for primary care and specialties. In order to qualify for a J-1 visa waiver, a physician must show that the proposed practice is located within a designated health care shortage area. Federal law permits up to 10 of the state’s 30 annual waiver slots to be used for practice locations outside of designated shortage areas, when the employer can demonstrate that it serves patients who live in shortage areas. These waivers are generally referred to as “Flex 10” or “Flex” waivers.

In addition to all other documentation required for a J-1 visa waiver, an application for a Flex waiver outside of designated shortage areas must contain documentation that the facility where the physician will practice has sufficient patients who live in designated shortage areas to support at least one Full Time Equivalent (FTE) physician of the specialty provided by the physician named in the waiver application.

The Minnesota Department of Health may recommend no more than 10 Flex applications in any federal fiscal year (October 1-September 30).

The Ohio Department of Health (ODH) participates in the State 30 J-1 Visa Waiver, the Appalachian Regional Commission and the National Interest Waiver programs in order to increase access to health care services for Ohio’s vulnerable and underserved populations. Qualified international graduates granted waivers must serve full time in a clinical capacity and provide health care to all patients regardless of their ability to pay.

Eligibility The J-1 Visa Waiver Program is open to all physician specialties, although the preference is for primary care physicians. J-1 physicians seeking waivers cannot apply directly to ODH; applications are accepted only from sponsoring health care facilities. Sponsoring health care facilities as well as J-1 physicians must accept Medicaid, Medicare and uninsured patients, and must provide a sliding fee scale based on 200 percent of the current federal poverty level.

The PCRH supports the Conrad State 30 J-1 Visa Waiver Program and is the agency designated by the Governor of the State of Utah and the United States Department of State to act as the "Interested Government Agency" for physicians requesting J-1 Visa Waiver's in the State of Utah. PLEASE NOTE: As of April 20, 2009,only the following counties are eligible for J-1 visa waiver placements:Cache, Daggett, Duchesne, Emery, Garfield, Grand, Juab, Kane, Piute, Utah, and Wayne,as well as select primary care HPSA designated Census Tracts: Central Weber, Magna, Midvale, South, Southeast, and West Valley located in Salt Lake and Weber counties.

The need in those communities not listed has been filled. You can go to the following web site to see if an employment site is located in a "primary care" health professional shortage area (HPSA); or you can view a HPSA map by clicking on "Health Professional Shortage Areas" or the button to the left with the same title. Utah does not use medically underserved area or medically underserved populations (MUA/MUP) designations to consider employment sites eligible for J-1 visa waiver placements.

J-1 VISA WAIVER requests Will ALSO be considered by the Utah Department of Health for Specialists and Sub-Specialists racticing in NON-HPSA designated areas, if the employment site meets the FLEX Slot requirements listed below.

"Primary Care" physicians include: Family Practice, Gynecologic, Internal Medicine, Obstetric, Pediatric, and Psychiatry.

Physicians with J-1 Visa's must find position in the State of Utah. We do not place providers or match with sites. Site must meet the US Department of State eligibility criteria.

A limited number of J1 Visa waivers are granted to non-resident physicians who agree to work in an underserved area of Vermont for a period of three years. Vermont considers waivers for all specialties that provide direct patient care and based on community need and shortage designation. It is important for physicians who practice in Vermont to understand that Vermont enjoys 4 distinct seasons with the accompanying extremes of temperature and that most of the state is considered rural.

Washington participates in the State 30 program with a focus on increasing access to care for Medicaid patients for primary care and specialists. Applications must come from a qualifying entity with a signed contract. If you have questions please contact Renee Fullerton.

West Virginia coordinates and administers the waiver through the two following Federal programs: Appalachian Regional Commission J-1 Visa Waivers

The physician’s request must be sponsored by a state located within the Appalachian Region. The physician must agree to provide primary clinical care for 40 hours per week at a site located in a Health Professional Shortage Area. West Virginia’s J-1 Visa Waiver Program requires a three year service obligation

Department of State “Conrad 30” Program Physicians must agree to provide medical care for a minimum of 40 hours per week in either a Health Professional Shortage Area or a Medically Underserved Area.

Sub-specialists and specialists are allowed to participate in this program, in addition to primary care providers. West Virginia J-1 Visa Waiver Program requires a 3 year service obligation.
