H1B process. Let us start from the beginning of our process and take you through to the H1B issuance.
Why you need us:
In your research you have undoubtedly found that most facilities are opposed to the hiring of Visa Physicians. There are several reasons why this may be:
First, they may feel a job is being taken away from an American. Regardless of whether an American even wants the job, every employer believes the position they offer is quite attractive. In spite of the reality of their experience, administrators generally believe that if they wait for the right American physician, he/she will be much more likely to stay in their town than would an FMG.
Second, over the years the belief has developed in HPSA/Underserved communities that a Visa Physician only wants a Green Card and the day after their physician is eligible, he or she will be leaving the job for a much better one elsewhere. Unfortunately this is very often true. Working alone, you, as the Visa Physician, may have difficulty changing their minds or convincing them of your value and stability.
Third, the paper work involved in getting a waiver position is enormous and difficult to manage on your own.
Even though all these obstacles exist, I have the expertise to help you overcome them and find you a position that will work for you and your family.
How we serve you
We can get you the interview. We demonstrate to the facilities that you are indeed an attractive candidate, and that we can also offer you other choices and locations that qualify for a waiver. This is important because I can show the facility that if you select their location you will likely stay longer, because your choice is a real choice and not just one decided by a matter of convenience.
Before the Employer will even consider speaking with you, we must convince them that you have the credentials. I have to show:
· That your MedicalSchool is accredited by the W.H.O.
· That your residency program is strong
· That you are fluent in English
· That your spouse is open to re-location
· That you are fully capable of passing your Board Exams
· That you will have no problem with licensing
· That your J1 waiver and H1B visa will be painless and cost free for the facility
This is a job for a sales professional.
We manage the paper
If the Employers have ever tried sponsoring a J1 unassisted, they will have found the process lengthy, perilous and difficult. I manage this for both of you. The paperwork and effort applied to this process is very time-consuming. You will need to do or know the following:
1. The candidate must file a 30-page application.
2. Letters of support should accompany it from Senators, Congressmen, Community Leaders, Hospital Administrators, and Local Pharmacists.
3. You need to know what every practice in the community generates as a gross income, how many patients they see per day, and whether or not they accept Medicaid, Medicare, and State or Federal funding.
4. In the last 3 years, has another J1 been placed in this community? If so, because they are still on a Visa status, he/she will not register as a full time Physician in the community. This means that the 1:3000 HPSA ratio may not be accurate and your application will be denied.
5. After the case is filed and it is proven that you are desperately needed (this alone is approx. 4.5 inches of paperwork.) there are usually requests from the State for additional information. I must collect what is needed immediately or the authorities may deny the application or fill the remaining 30 spots with other Candidates who are not fellowship trained. (Remember that no state wants to sponsor fellowship trained physicians.)
6. If the individual State recommends you, your file is forwarded to the Federal Department of State. Again they review it all very carefully. They may have additional requests and I must get more information.
8) Finally, if everything is in good order, the Federal Department of State recommends the file and it is given to Dept. of Homeland Security-BCIS (former INS). When your file arrives here, it is time to begin your change of status (H1B) concurrently. This is a separate process that again involves filing, Attorneys fees etc.
As you can see - if a Hospital tries to do this on their own they will sometimes get half way through and say "forget it - go find another job". Also some Hospitals may actually get through the process, but the timing is too long and then the State is full. Even if everything actually goes well - the hospital swears that it will never do it again -, as the paperwork is just a logistic nightmare for them.
Additional Expenses
Filing costs for States can vary. For example, Texas & Oregon are $2000, Michigan is $1,500. while Virginia & Georgia are free. State licensing runs from $450 to $1,150, and the Family H4's are usually an additional $100 (all members included). Fast tracking through the system is another $1,000 paid directly to the Department of State and this drops the processing period from 6-8 weeks to 2 weeks.
If you choose to find a position on your own, you may find that legal fees are between $7,500 to $10,000, and although you are given a checklist of things to do, you might be given little assistance. You must collect all of the data on your own, and since you'll usually be busy in your Residency or Fellowship, you will most likely have to pay someone else to collect this data for you.
We can ensure that all legal and associated fees are covered by the Employer (hospital, group, practice)
